As of May 2011 all UK companies (and EU) have to comply with the new "Privacy and Electronic Communications Regulations (PECR)" regulations. From what I can see the only part that Salesforce currently is non-compliant with is the email tracking (and any automated emails). Everytime you send an HTML email or Text email (and the mail client can render HTML emails) a tracking pixel is embedded in the email so that you can see if the customer opened the email. This will be illegal as of May unless you have prior authorisation. This is both for new customers and existing.

My question is:

Can this be disabled globally in an org so that we can disable this tracking pixel. Can we stop all emails coming out of Salesforce if the "OPT Out of Email" flag is ticked?

    I'm curious to know to

You might want to send SFDC a note regarding PECR as they are pretty good with keeping up with regulatory mandates.
