Consent is not a generalized, one-size-fits-all concept. Treating all communication channels identically is a massive regulatory compliance risk. Different digital communication channels possess vastly different legal constraints, operational rules, and carrier expectations. Marketing Cloud Next allows your organization to manage these complex nuances by separating consent by specific channel type. Next, explore how consent legally and functionally operates across the three primary digital channels: Email, SMS, and WhatsApp.

Email remains the most prominent and common digital marketing channel worldwide, but it still requires strict adherence to powerful international laws like the CAN-SPAM Act in the United States, CASL in Canada, and the GDPR in Europe.

In Marketing Cloud Next, all outbound promotional emails must be tied to a specific Communication Subscription before the system allows them to be sent. Furthermore, every single promotional email dispatched through the system requires a visible unsubscribe link or a direct link to your branded Preference Pages. When a user clicks that unsubscribe link, the system automatically updates their related Communication Subscription Consent record within Data 360 to an OPT_OUT status.

It’s important to understand the distinct difference between promotional emails and transactional emails. Transactional emails—such as post-purchase order receipts, password reset links, or critical shipping updates—do not require a promotional subscription to send because they are essential to completing a transaction the user initiated. However, you must still maintain compliance and respect global opt-outs if a user requests to be removed and forgotten from your database.

SMS marketing is a powerful tool, but it’s highly regulated by powerful mobile telecom carriers and government regulatory bodies like the Federal Communications Commission (FCC). Mobile carriers implement strict rules to prevent mobile spam.

You must obtain an active, explicit, and verifiable opt-in from a user before you’re legally allowed to send them a promotional text message. The concept of implicit consent or prechecked boxes is never legally acceptable for SMS communications.

Marketing Cloud Next assists in managing SMS compliance through automated keyword handling. If a customer replies to your SMS message with universal keywords like STOP, CANCEL, or UNSUBSCRIBE, the system intercepts this keyword instantly. It immediately updates their phone number’s specific consent status to OPT_OUT, blocking future text sends. To remain compliant, you must ensure your initial sign-up web forms clearly and prominently state the exact types of messages the user will receive, the expected monthly frequency of those messages, and explicit instructions explaining exactly how they can opt out later.

WhatsApp operates on an entirely different paradigm. It’s strictly governed by Meta’s rigorous corporate commerce and business messaging policies. Before you can even attempt to send a proactive, promotional template message to a user on the WhatsApp network, you must collect active, explicit opt-in from them.

This required opt-in cannot be vague. It must clearly and explicitly state that the specific user is agreeing to receive communications from your specific business entity directly on the WhatsApp platform. You cannot simply purchase a list of phone numbers, load them into Marketing Cloud Next, and begin broadcasting WhatsApp templates.

Users can opt out by blocking your business within the WhatsApp mobile application interface, or by sending a specific opt-out text keyword if you have configured one. Marketing Cloud Next integrates with WhatsApp’s APIs to ensure that the exact moment a user revokes their consent, all future promotional template messages are permanently suppressed. It’s vitally important to actively monitor your WhatsApp business quality rating. Consistently sending template messages to users who haven’t properly opted in, or sending irrelevant content that causes users to block you, leads to severe restrictions and can get your business account banned by Meta.

Opt-In and Opt-Out Mechanism

To summarize how these channels operate, it’s crucial to remember the golden rule of Marketing Cloud Next: Both opt-in and opt-out statuses are identified by a composite key consisting of the Communication Subscription (flash sales, product updates, or others), the Contact Point (email or phone number), and the Engagement Channel Type (Email, SMS, or WhatsApp). Because they are separated by this composite key, changing your consent on one channel does not automatically affect that same subscription on another channel. For example, if a user opts in or out of Email for Flash Sales subscription, this choice has zero carry-over effect on their SMS consent for Flash Sales.

SMS consent introduces an additional layer of specificity regarding sender codes. SMS consent and opt-outs are strictly sender-code specific. A sender code is the phone number or short number code that a brand uses to send SMS messages. For instance, if your brand uses three different SMS sender codes, you require separate opt-in and opt-out tracking per individual code. So if a user opts out of one specific sender code, it doesn’t alter or affect their consent status on the other two codes.
